I think the webmaster should trademark the name Winnipesaukee. Before someone else does it.

For a large local employer like the Omni Hotels-Mount Washington to go looking around the Bretton Woods area for other businesses using that name seems like a big stretch. Probably, someone in upper manangement has been listening to some lawyerly advice. Is this a case of getting over-lawyered? Sounds like it could be....anyway....doesn't the Lake Winnipesaukee cruise ship, the Mount Washington, also spell their name the same way.
So, who has the legal intellectual property right to call themselves the Mount Washington, the hotel in Bretton Woods, or the big boat on Lake Winnipesaukee? Is there a Franklin Pearce School of Law, intellectual property rights attorney on-board this forum who can make some professional comments here...........and of course say them for free.... ![]() www.omnihotels.com/mountwashington (story in today's Union leader)

Better yet, perhaps the winnipesaukee logo should be copyrighted before someone steals it.

it's the HOTEL MOUNT WASHINGTON and isn't it M/S MOUNT WASHINGTON?
Mount Washington is a big big hill up north. Nothing wrong with The Inn at Mount Washington, or the Mount Washington restaurant. |

My guess is this will go away as quickly as it has come up. People do things like this because they want to see if they can slip it through the cracks and get some advantage. When they don't and it meets resistance, they back down.
The name "Mount Washingotn" is used so widely in the area, in connection, with resturants, hotels, and local business that this is bound to fall flat on its face.

If the hotel is concerned about confusion then perhaps they should change their name. I always thought they were the bretton woods hotel anyway and I somehow doubt people confuse their hotel with these smaller places.

BRETTON WOODS – The corporate owners of the Omni Mount Washington Resort have applied for a federal trademark to prevent other lodging facilities from using its name, but say they are not trying to keep anyone else from using the name of the highest peak in the Northeast. "The Mount Washington Resort at Bretton Woods has been using 'Mount Washington' as one of its brand names for more than a century, and under well-established legal precedents, that means the resort already owns that trademark for its resort services," Stephen K. Rice, managing director and senior vice president of the resort's owner, CNL Lifestyle Company LLC, wrote in a letter provided to the New Hampshire Union Leader. CNL Lifestyle Company today will file a clarification with the U.S. Trademark Office in Washington, D.C., stating that the trademark would apply only to hotels, lodges and inns named in such a way that it could create confusion, Rice said yesterday. It would not pertain to companies outside the lodging, hotel and inn industry, he said.
