Arrested for "Conduct"?...
"Conduct following an accident" was not listed on the WMUR transcript that followed.
Could an arrest apply to another recent accident? |

I would have tossed in assault and destruction of property, or similar stuff. People who behave recklessly should be held responsible for outcomes

This was not for the crash in Winter Harbor...This was for the boat that hit nipple rock...

Understood--it was the ramming of the police boat I was referring to, plus his injured passengers. He created a very dangerous situation. I am clueless on what typical penalties are for various offenses, so I'm not saying he should definitely get locked up, but it should be more than a bit of negligence.

One to the other
So what are the details where this driver is arrested and the Hit and Run driver was/is not. (At least at this point) Is it due to the H&R still being an open case? Seems "sort" of similar in terms of reckless operation, no?
What is the tipping point between an unfortunate boating accident and an arrestable offense? |

The appearance to me is damage or injury to others, in most cases. You back into a retaining wall in a parking lot or drive into a rock in the lake, only your property, car or boat, is damaged, no injuries, call the tow truck/boat and go home. Injuries or damage over a $$ limit, report, or get cited for not reporting. Possibly get cited for leaving the scene if it is a reportable accident. At Nipple Rock, there certainly was a lot of damage and injuries and the driver was identified.
In the Winter Harbor H & R, it appears there has not been sufficient info or corroboration as to who the driver was. Without that, who gets the summons? The insurance is on the boat, not the driver, so both boats and dock owner will get reimbursed. Your insurance is in effect even when you are breaking the law, e.g. speeding, running a stop sign, going on the wrong side of a buoy (which really isn't illegal). |
