Cell Phone User while under way?

It is a good thing that states have gotten onboard with making non-hands-free cell phone use illegal while driving cars.

Does anyone know if the recent (within a year) NH law banning cell phone use (not hands free) in cars is also applied to persons driving a boat? It goes to reason that it should but I haven't seen in advertised and spelled out the way it was for car drivers when the law was enacted.

RSA 265:79c clearly pertains ONLY to motor vehicles. The new regulation does not pertain to individuals operating boats.

Please don't give these politicians any more ideas. They have done enough damage to the fun of boating on Winnipesaukee.

Boats have motors and the same DUI laws apply.... Can boats be considered MOTOR vehicles?

With the current APPs that allow things like weather radar, and some chart applications ( not necessarily for the lakes) to not allow usage is insane.

Now if your doing nothing but talking or texting, instead of on watch while boating, that's already understood to be stupid.

No, a boat is not a motor vehicle by legal definition.

In the case of boating while intoxicated, a specific paragraph was appended to the existing motor vehicle code (RSA 265-A:2 II) to add the operation of a boat to existing code. In order for boats to be included in the law governing hands free devices, the legislature would have needed to add language specifying a boat was included. Since they did not, the RSA in question does not pertain to boats.
